1. Agreement to Terms

By accessing or using AptSide ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

AptSide is a house and land matching platform that helps users:

  • Search for house designs that fit their block dimensions
  • Generate feasibility reports for design-lot combinations
  • Connect with builders through enquiry submissions
  • Save and compare shortlisted designs

3. User Accounts

3.1 Account Creation

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for safeguarding your account password and for any activities that occur under your account. You must notify us immediately of any unauthorized use.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion.

4. Payments and Subscriptions

4.1 Pricing

Certain features of AptSide require payment. All prices are in Australian Dollars (AUD) and include GST where applicable. Prices may change with notice.

4.2 Payment Processing

Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service and privacy policy.

4.3 Refunds

Due to the digital nature of our services, refunds are generally not provided once a report has been generated or accessed. Contact us for exceptional circumstances.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Scrape, harvest, or collect data without permission
  • Impersonate another person or entity
  • Upload malicious code or content
  • Use automated systems (bots) without permission
  • Resell or redistribute the Service without authorization

6. Intellectual Property

6.1 Our Content

The Service and its original content (excluding user-provided data), features, and functionality are owned by AptSide and are protected by intellectual property laws.

6.2 Your Content

You retain ownership of data you provide. By using the Service, you grant us a license to use, store, and process your data as necessary to provide the Service.

7. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability or fitness for a particular purpose
  • Accuracy or completeness of information
  • Uninterrupted or error-free operation
  • Security of your data

Important: AptSide provides matching and feasibility tools for informational purposes only. Results should be verified with qualified professionals (builders, surveyors, planners) before making decisions.

8. Limitation of Liability

To the maximum extent permitted by law, AptSide shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or business opportunities
  • Errors or inaccuracies in matching results
  • Decisions made based on our feasibility reports
  • Actions of third-party builders

Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.

9. Indemnification

You agree to indemnify and hold harmless AptSide, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Third-Party Services

The Service may contain links to third-party websites or services (builders, payment processors). We are not responsible for the content, privacy policies, or practices of third-party services.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Victoria, Australia.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms on this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.
